How does IR35 impact HR contractors?
IR35 legislation affects the type of contract that our Associates can work to and for each assignment, our clients will assess whether the scope of role falls Inside or Outside IR35.
IR35 status is determined by the nature of the engagement, not job title.
– Inside IR35: Treated like an employee for tax purposes. You’ll pay income tax and National Insurance through PAYE. For opportunities that are deemed inside IR35 we would engage contractors through an Umbrella Company. Individuals may have a preferred Umbrella Company that they wish to use or we can provide options when we discuss the assignment with you.
– Outside IR35: You can operate through a Limited Company or Sole Trader contract
Should I set up a Limited company?
You can operate as a Ltd Company contractor for opportunities that are assessed as outside IR35 however for a contract inside IR35, where off payroll working rules apply, we will not be able to process a contract via Ltd Company.
I notice that you offer HR interim and consultancy opportunities – what is the difference?
These terms are interchangeable within the marketplace however within Hunter Adams, we typically define them as follows:
– Interim: Involves short to medium term assignments where you are embedded within a business to cover BAU work, maternity cover, or transformation projects. This tends to be set days/hours over an agreed duration. Typically, these will be more likely to fall inside IR35 however there are opportunities that do fall outside of IR35.
– Consultancy: More strategic and often project based fractional support. You may be brought in to solve specific business challenges or lead transformations, often doing an initial scoping assessment to provide an estimation on number of days. Typically, these will be assessed as outside IR35 but this will be determined by the client as the end user.
